If you are trying to find a lawyer, the chances are that it is because you have a need to obtain some advice on a legal matter of some kind, or to resolve a dispute, large or small. And you should talk to a lawyer who is familiar with your problem in order to get the best advice.
Lawyers are necessary if you find yourself in a dispute with someone. Maybe you have been sued by someone, or you need to sue someone. There are also contract disputes, disputes between buyers and sellers of real property, disputes between landlords and tenants, disputes within families when a family member dies and either no estate plan is in place, or the one in place is out of date and/or inadequate. And sometimes there are disputes despite the carefully worded contract or the best intentioned estate plan.
As a last resort, many such disputes end up in court. After all, that is what the courts are for, right? Well, maybe. If litigation is necessary, it is becoming more and more problematic to resort to the courts to resolve disputes. Litigation has become so expensive that it is difficult, if not impossible, for many to afford to go to court, except for jury duty. At the same time, our courts are also facing significant budget shortfalls resulting in court closures and overworked judges. This means that resolving a court case takes longer, and becomes less than cost effective. In some cases, mediation and perhaps arbitration (Alternate Dispute Resolution or ADR) may resolve disputes, but these alternatives have also become costly and problematic as well.
However, there are other solutions such as negotiation, ADR if appropriate, with litigation as a last resort. I have been practicing law in Orange County for nearly 40 years helping people resolve disputes.
In addition to legal services, I offer ADR services. My fees for those services are less, sometimes substantially less than the large ADR providers offer. And there are no administrative or “set up” fees that most providers charge.
